A2Purpose of the website
The website gives general information about our garden maintenance service and how to contact us. Nothing on the website is a binding offer to carry out work at a particular time, in a particular way or for a particular charge.
A3Acceptable use
You agree not to use the website in any way that is unlawful, that could damage or disrupt it, or that tries to gain unauthorised access to it, its server or any connected system. You must not copy the site in bulk using automated tools.
A4Photographs, videos and text
The text, logo, design, photographs and videos on this website are used by Garden Maintenance and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. Any other reuse needs our written permission.
A5Links away from this site
Where we link to an outside website, such as a map service, we do so for convenience only. We do not control those sites and are not responsible for their content or availability.
Garden maintenance arrangements
B1Agreeing a maintenance arrangement
Any garden maintenance work is arranged directly between you and us. The tasks, visit pattern, charges and any other conditions are confirmed with you in writing, usually by email, before work begins. If those written details differ from these terms, the written details for your arrangement take priority.
B2Access to your garden
You agree to give safe, reasonable access to the areas of the garden included in the arrangement at the agreed times. Please make sure gates can be opened, pets are secured and anything fragile is moved or pointed out beforehand.
B3Information you give us
You are responsible for telling us about anything in the garden that could affect the work or safety, such as buried cables or pipes, irrigation lines, uneven ground, wasp nests, or plants you want left untouched. We rely on the information you provide.
B4Weather and changes to visits
Garden work depends on the weather and ground conditions. A visit may need to be moved when conditions are unsafe or would harm the garden. Either party may ask to change a visit, and we will work with you to agree a new time.
B5Living plants
Plants are living things affected by soil, weather, pests, disease and many other factors outside our control. We carry out work with reasonable care and skill, but we cannot promise a particular growth result or appearance.
B6Ending an arrangement
Either you or we may end an ongoing maintenance arrangement by telling the other in writing. Any notice period or payment for work already completed will follow what was agreed for that arrangement.
General legal terms
C1Limits on our responsibility
We work to keep the website accurate and available but do not promise that it will always be complete, current or free from errors or interruption. To the extent allowed by law, we are not liable for indirect or consequential loss arising from use of the website.
Nothing in these terms limits any liability that cannot legally be limited.
C2Your responsibility
If you break these terms and that causes a claim or loss for us, you agree to cover the reasonable costs that result, to the extent permitted by law.
C3Governing law
These terms are governed by the laws of the Commonwealth of Kentucky and applicable United States law. Any dispute will be handled by the courts that have jurisdiction in Kentucky.
C4If part of these terms is invalid
If a court decides that any part of these terms cannot be enforced, the remaining parts continue to apply.
